There are many reasons to formally establish paternity in Utah. There are a number of reasons that an action to establish paternity is filed. A paternity action allows the parties to establish their rights regarding custody, visitation, and support.
Custody – The court will establish both physical and legal custody of the child. Physical Custody dictates which parent provides the shelter and care for the child on a daily basis. Legal custody gives the right to participate in making decisions regarding the child such as medical care, education, and religion.
Child Support – Child support will be set up by the court based on each parent’s income.
Visitation – The court will determine the amount of visitation the non-custodial parent is entitled to have.
Fathers should make sure that their rights are protected. Utah law requires that a father file an acknowledgement of paternity and take actions to support the child both before and after the birth.
